Dogs allowed at Lotz Park in Boyd

Man’s best friend is officially allowed at Lotz Park in Boyd—with some conditions.
Moving to approve the new ordinance at its Monday meeting after adding the item to the agenda following receipt of a draft ordinance earlier that day, the multipoint, three section ordinance with a severability clause requires dog owners to pick up after their pets and also prohibits dogs from being present on athletic fields or the area around the concession stand. Dogs may also be prohibited during spacial events or in specific areas, with any notice of temporary prohibition posted on site.
The full ordinance reads as follows:

An Ordinance Regarding Dogs in Village Park(s)
SECTION I. Repeal and Adoption of Provisions.
Section 12-1-1(b)(24) of the Village of Boyd Code of Ordinances is repealed and recreated as follows:
(24) Dogs.
a. Dogs and other animals/pets are only permitted in the Village Park and other Village-managed recreation areas only as allowed pursuant to this Subsection.
b. Dogs are allowed in the Village Park but only if such dogs are at all times fully controlled by their owner/handler and are on a leash that is no more than six (6) feet in length.
c. Dogs are prohibited at all times from being present on athletic fields or the area around the concession stand.
d. Dogs may be prohibited from being present at certain events or in specific areas within the Park or other Village-managed recreation areas in conjunction with a special event. Notice of such temporary prohibition shall be posted at the site.
e. Dog owners/handlers are required to remove any excrement deposited while such dog is in the Village Park or any other public property. This requirement is further described in Section 7-1-10(a) Animal Feces.
f. While present in the Village Park or other public property, dogs shall not disturb the peace, as defined in Section 7-1-12 Barking Dogs and Crying Cats.
g. Dangerous, threatening or violent behavior by dogs is prohibited at all times. The owner/handler is responsible for any damage/injury caused by his/her dog to other persons, animals, or public property. The Village of Boyd is not liable for any damages so caused. Dogs deemed to be dangerous or violent, as determined in the Village’s sole and absolute discretion, are prohibited from being present in the Village Park or on any other public property.
h. The penalty for a violation of this Subsection shall be as provided in Sections 1-1-6 and 1-3-1 Schedule of Fees and Deposits.

SECTION II. SEVERABILITY.
If any provision of this Ordinance is invalidated ore is found to be unconstitutional or if the application of this Ordinance to any person or circumstance is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid or unconstitutional provisions or applications.

SECTION III. EFFECTIVE DATE.
This Ordinance shall take effect upon passage and publication as provided by law.”
