July 18 1:19 a.m.

Officer made a traffic stop after observing a

vehicle traveling southbound on County Highway D conduct a U-turn at the intersection of Highways D and X while failing to stop at the stop sign or use a turn signal, and traveling left of center on County D. In addition the vehicle’s registration plate lamp was non-functional. Upon being stopped the vehicle’s front driver door was rapidly thrown open, resulting in the officer radioing Chippewa County Dispatch that

the individual displayed uncommon behavior

for a routine traffic stop, but that the driver re mained in the vehicle.

At 11:28 p.m. or ten minutes after initial ob- servation, officer introduced himself to the driv –

er, identified by a Wisconsin picture driver li cense as Steve Kmieciak. Driver provided proof

of insurance for the vehicle. Officer observed

that Kmieciak had an “obvious odor of intoxicants” and that his speech was slow and slurred. Upon being asked where he was coming from and where he was going, Kmieciak said from Altoona and then “south of (incoherent speech)” for his destination, with a second attempt resulting in the same incoherent speech.

Officer returned to squad car to send the driv er’s information to Chippewa County Dispatch

and also to request a second officer. The driv er’s license came back as being valid, while the

officer shared his concerns with dispatch about

suspected intoxication by Kmieciak. Asked if he had any alcohol, Kmieciak stated “a few,” then

"three," and finally "about three hours ago."

Asked where he was, Kmieciak stated, “I don’t know.”

Officer then administered field sobriety tests

to the driver, determining from the Horizontal Gaze Nystagmust Test that more than four clues

were present, while Officer Johnson of the Stan ley Police then arrived on scene.

The Walk and Turn Exercise allowed for determination that more than two clues were pres- ent, with the officer first demonstrating how to

do the exercise so that Kmeiciak understood. A One Leg Stand Exercise, meanwhile, resulted in a loss of balance and the determination that more than two clues were present.

Kmeiciak then took a breathylyzer test but refused to blow hard enough to register. Arrest decision was made based on officer observa tions and information, with Kmeiciak advised that he was being placed under arrest for OWI at approximately 1:40 a.m. Kmeiciak’s vehicle was parked in a nearby parking lot. Kmeiciak was then transported to St. Joseph’s Hospital for a legal blood draw at approximately 2:17 a.m. Kmeiciak was then transported to the Chippewa County Jail, with officer clearing from the jail

for a return to Boyd at 3:48 a.m. The Boyd Police Department requested restitution of $30 for the legal blood draw fee. Additional action was pending as a result of the draw.

July 21 6:38 p.m.

On the above date and time, Boyd police received a complaint of a suspicious man looking through garbage cans in the 300 block of North Boyd Street. The man was described as wearing a green shirt and having a backpack. Police investigated the area but were unable to locate anyone matching the description. No report.
